Terms of Service

These Terms of Service govern the use of services provided by Raptor Process Serving LLC. By submitting a service request through this website, submitting doucuments for service, or otherwise engaging the services of Raptor Process Serving LLC, the requesting party agrees to the following terms.

Services Provided

Raptor Process Serving LLC provides professional service of legal documents and related support services within designated service areas. Services may include routine service of process, rush service, and documentation of service attempts including affidavits of service.

Client Responsibilities

Clients are responsible for providing accurate and complete information necessary to complete service, including but not limited to:

• Full name of the individual to be served
• Accurate service address
• Case information if applicable
• Any relevant instructions regarding service

Raptor Process Serving LLC is not responsible for unsuccessful service resulting from inaccurate or incomplete information provided by the client.

Service Attempts

Standard service includes up to three attempts at the address provided unless otherwise agreed. Attempts will be made at reasonable times and may vary depending on circumstances.

Service attempts may occur at varying times of day, including evenings or weekends when appropriate, in order to increase the likelihood of successful service. 

Successful service cannot be guaranteed if the individual is not present, has relocated, or cannot be identified at the provided address.

Additional service attempts beyond those included in the standard service may require additional fees.

Access to Service Locations

Service attempts are made at the address provided by the client. Raptor Process Serving LLC is not responsible for delays or unsuccessful service resulting from restricted access locations, including gated communities, secured buildings, private property restrictions, or locations requiring special access permissions that are not provided by the client.

Successful Service Disclaimer

Raptor Process Serving LLC makes good faith efforts to complete service of process based on the information provided by the client. However, successful service cannot be guaranteed. Completion of service may depend on factors outside the control of Raptor Process Serving LLC, including the availability of the individual being served, cooperation of the recipient, access to the service location, and the accuracy of the information provided by the client.

Evasion of Service

Raptor Process Serving LLC makes reasonable efforts to locate and serve the individual identified in the service request. However, service may be unsuccessful when individuals actively evade service, refuse to identify themselves, avoid contact, relocate, or otherwise make themselves unavailable. Raptor Process Serving LLC is not responsible for unsuccessful service resulting from such actions.

Court Proceedings and Legal Outcomes

Raptor Process Serving LLC provides service of legal documents and documentation of service attempts. Raptor Process Serving LLC is not responsible for legal outcomes related to the use of those services, including but not limited to case dismissals, delays, court rulings, or challenges related to service of process.

Clients are responsible for ensuring that documents provided for service comply with applicable laws and court requirements.

Service Area

Raptor Process Serving LLC primarily provides service of process within Horry County and Georgetown County, South Carolina. Service in additional counties or jurisdictions may be available upon request or through the use of subcontractors or third-party service providers. Availability of service outside the primary service area may vary and may require adjusted pricing.

Payment Terms

Payment policies vary depending on the type of client.

      Attorney and Law Firm Clients

Payment is due upon completion of service unless other billing arrangements have been established with the client. Invoices will be provided for services rendered and are generally expected to be paid within a reasonable period following receipt. Established law firm clients may be approved for billing arrangements at the discretion of Raptor Process Serving LLC. 

Raptor Process Serving LLC reserves the right to suspend or decline additional service requests for accounts with outstanding balances.

     Non-Attorney Clients

Payment may be required in advance prior to service attempts unless otherwise agreed. Service requests may not begin until payment has been received.

Additional services such as rush service, extended time on location, multiple addresses, or service outside the primary service area may require additional charges.

Service Refusal, Safety, and Refund Policy

Raptor Process Serving LLC reserves the right to decline or discontinue service requests when necessary due to safety concerns, legal restrictions, incomplete information, or other circumstances that may prevent the proper completion of service.

In certain situations, investigative or locate services may be required in order to attempt service. Any such services may be performed by a properly licensed private investigative agency when required by applicable law.

Service fees are earned upon commencement of service attempts and are generally non-refundable once service attempts have begun. If a service request is cancelled prior to the first attempt, a refund may be issued at the discretion of Raptor Process Serving LLC, less any applicable administrative or processing costs.

Use of Subcontractors

Raptor Process Serving LLC may utilize subcontractors or third-party service providers to assist in completing service requests when appropriate. Any such subcontractors or service providers operate under the direction of Raptor Process Serving LLC and are expected to perform services in accordance with applicable laws and professional standards.

Affidavits and Documentation

Affidavits of service and related documentation are prepared based on the information and reports provided by the individual who performed the service attempts. When subcontractors or third-party service providers are utilized, those individuals are responsible for the accuracy and truthfulness of the statements contained within their affidavits or service reports.

Raptor Process Serving LLC relies on the representations provided by the individual who performed the service attempts and is not responsible for inaccuracies resulting from false or misleading information provided by subcontractors or third-party service providers.

Recording and Documentation

Service attempts may be documented through written notes, photographs, audio recordings, or video recordings when appropriate for safety, documentation, or verification purposes. Any such recordings are intended solely for internal documentation, evidentiary purposes, or client reporting and will not be publicly distributed except as required by law or court proceedings.

Subcontractors or third-party service providers may also utilize similar documentation methods while performing service attempts in accordance with applicable laws.

Raptor Process Serving LLC does not provide legal advice. Clients seeking legal guidance should consult a licensed attorney.

Limitation of Liability

Raptor Process Serving LLC performs services in good faith based on the information provided by the client. Raptor Process Serving LLC shall not be liable for damages, delays, or losses arising from circumstances outside its reasonable control, including but not limited to inaccurate information provided by the client, inability to access a service location, unavailability of the individual to be served, or actions of third parties.

To the fullest extent permitted by law, the liability of Raptor Process Serving LLC for any claim related to services provided shall be limited to the amount paid for the service giving rise to the claim.

When subcontractors or third-party service providers are utilized, they act as independent service providers performing service attempts or related tasks. Raptor Process Serving LLC shall not be responsible for damages arising from the independent actions or omissions of such subcontractors or third-party service providers beyond the scope of services requested.

Acceptance of Terms

By requesting service from Raptor Process Serving LLC, the client acknowledges and agrees to these Terms of Service.

Governing Law

These terms shall be governed and interpreted in accordance with the laws of the State of South Carolina.

Changes to Terms

Raptor Process Serving LLC reserves the right to update or modify these terms at any time. Updated terms will be posted on this page with the revised date.
